Watching Brief for New infoGROUP Counsel

ORC parent infoGROUP has named Thomas J. McCusker as Executive VP for Business Conduct and General Counsel. He will oversee the firm's legal affairs and its compliance with new corporate governance controls adopted following recent litigation and the sacking of founder Vin Gupta.

McCusker will be based in the firm's Omaha headquarters and will report to Chairman Bernie Reznicek, also working closely with CEO Bill Fairfield. He joins in December from Mutual of Omaha, where he has served for 14 years as Executive VP and General Counsel. He began his legal career at Cravath, Swaine & Moore in New York City and was later a partner at the law firm of Kutak Rock. He graduated Cum Laude from the University of Notre Dame School of Law in 1969.

Says Reznicek: 'Tom has a tremendous amount of experience in both corporate and private law and we are pleased he has agreed to join our team.'

The new position was created at the conclusion of the internal investigation and the settlement of shareholder derivative litigation in July this year, with John Longwell acting in the role. Longwell has worked with the Board and new management to implement sweeping governance changes and to eliminate expenses associated with former CEO Vin Gupta, including an 80-foot yacht, apartments in Hawaii and California, and a University of Nebraska stadium box. Longwell will remain with the company to help McCusker into the role.
