Judge Scraps TRA/Kantar Patent Claim Decision

October 18 2013

In the US, the judge who threw out TRA's patent infringement lawsuit against Kantar has now ordered that decision to be withdrawn from the record.

Judged... and unjudged again: TRA's claimTiVo-owned TRA originally claimed that Kantar had infringed its patents while reviewing them as part of merger talks from which it later withdrew, subsequently launching a competing product called RapidView.

Last week, TRA appealed to Judge Shira Scheindlin to reconsider her previous decision to throw out its claim, saying it had not been given a 'full opportunity to be heard' and suggesting that the judge may have 'simply overlooked' a previous agreement that she would hold an oral hearing before coming to a decision. Scheindlin has now retracted her order from the case file, without at this point providing any explanation for doing so.

DRNO will follow the case as the implications of this decision / indecision become clear...
